Terms of Service

1. Acceptance of Terms

By accessing or using CultureCheck at culturecheckgame.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a binding legal agreement between you and Tech God LLC (“we,” “us,” or “our”), a limited liability company organized under the laws of the State of Louisiana.

2. Description of Service

CultureCheck is an online trivia game focused on Black culture, entertainment, music, film, television, and related topics. The Service allows users to answer trivia questions, earn in-game currency (“Culture Coins”), compete against other players in real-time 1v1 matches, participate in daily challenges, and track scores on public leaderboards.

3. Eligibility

You must be at least 13 years of age to use the Service. By creating an account or using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Accounts

You may create an account using Google OAuth or an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at culturechecktrivia@gmail.com of any unauthorized use of your account.

You agree to provide accurate and complete information when creating your account and to keep your display name free of offensive, hateful, or otherwise inappropriate content. We reserve the right to remove or modify any display name that violates these Terms.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Harass, threaten, or harm other players
• Use cheats, exploits, bots, or automation to gain unfair advantage
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure
• Transmit viruses, malware, or other harmful code
• Scrape, crawl, or data-mine the Service without our prior written consent
• Impersonate any person or entity
• Use the Service for any commercial purpose without our prior written consent

6. In-Game Currency and Virtual Items

Culture Coins are virtual in-game currency earned through gameplay. Culture Coins have no monetary value, cannot be redeemed for real money or any other real-world value, are not transferable between accounts, and may be modified, reset, or discontinued at any time without notice or liability.

We make no guarantee that Culture Coins or any virtual items will be available indefinitely. We reserve the right to change, manage, or eliminate virtual currency or items at any time.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, trivia questions, game mechanics, and software — are owned by Tech God LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. User Content

Any display name, feedback, or other content you submit through the Service (“User Content”) must not infringe any third-party rights or violate any laws. You grant us a worldwide, royalty-free license to use, display, and reproduce your User Content in connection with operating and improving the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECH GOD LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless Tech God LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including for violations of these Terms. Upon termination, your right to use the Service will immediately cease, and all associated data including Culture Coins may be deleted.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Orleans Parish, Louisiana, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
